These Terms of Service (“Terms”) govern your access to and use of achievewithhuman.com (the “Site”), operated by Tens, Inc. (“Human,” “we,” “us,” or “our”). By using the Site or joining the Human waitlist after being presented with these Terms, you agree to them. If you do not agree, please do not use the Site.
1. What the Site Is
The Site provides information about Human and allows visitors to join our waitlist, contact us, and access links to third-party websites and services. The Human application is not currently made available through the Site. Any beta version or application that we later make available may be governed by separate terms.
2. Eligibility
The Site is intended for users who are at least 13 years old. If you are under the age of majority where you live, you may use the Site only with the involvement and permission of a parent or legal guardian. The Site is not directed to children under 13.
3. Waitlist and Email Communications
If you provide your email address and join our waitlist, you authorize us to send you product news, launch and early-access information, company updates, and related marketing communications. You may unsubscribe at any time using the unsubscribe link in our emails. You agree that the email address you provide is yours and that the information you give us is accurate.
4. Forward-Looking Information
Descriptions of features, functionality, availability dates, and development plans on the Site describe what we currently intend to build. They are not promises or guarantees, and they may change. You should not rely on descriptions of planned features, functionality, availability dates, or development timelines when making decisions. Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any security.
5. Acceptable Use
You agree not to:

—Attempt to gain unauthorized access to the Site, its systems, or any accounts or data
—Probe, scan, or test the vulnerability of the Site without our authorization
—Interfere with or disrupt the Site, including through denial-of-service attempts or introducing malicious code
—Use automated means to access, scrape, extract, index, or collect information from the Site, except as authorized by us or as permitted through ordinary public search-engine indexing
—Submit false information or impersonate another person or entity
—Copy, reproduce, or redistribute Site content except as permitted in Section 6
6. Our Content
The Site and its content — including text, graphics, images, logos, designs, and the Human name and marks — are owned by Tens, Inc. or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and view the Site for your personal, non-commercial use and to share links to publicly available Site pages. All rights not expressly granted are reserved.
7. Feedback
If you voluntarily provide us with comments, suggestions, or other feedback about Human or the Site (“Feedback”), you grant Tens, Inc. a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use and incorporate the Feedback for any purpose without compensation or attribution. This provision does not grant us rights in personal information, which is handled as described in our Privacy Policy. You represent that you have the right to provide the Feedback. Please do not submit confidential or proprietary information.
8. Third-Party Links
The Site may link to third-party websites and services, including social media platforms. We do not control them and are not responsible for their content, products, or privacy practices. Your use of them is governed by their own terms.
9. Privacy
Our Privacy Policy describes how we collect, use, disclose, and otherwise process personal information in connection with the Site. Please review it carefully.
10. Disclaimer
The Site is provided “as is” and “as available,” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty that the Site will be uninterrupted, error-free, or secure. Nothing in these Terms excludes any warranty or right that cannot lawfully be excluded.
11. Limitation of Liability
To the fullest extent permitted by law, Tens, Inc. and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any lost profits or lost data, arising out of or relating to your use of the Site. Our total liability for any claim relating to the Site will not exceed the greater of (a) the amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).
Nothing in these Terms limits or excludes liability to the extent it cannot be limited or excluded under applicable law.
12. Indemnification
You agree to indemnify, defend, and hold harmless Tens, Inc. and its officers, directors, employees, and agents from claims, liabilities, damages, losses, and reasonable attorneys’ fees arising out of or relating to: (a) your unlawful use of the Site; (b) your violation of these Terms; (c) your violation of another person’s rights; or (d) content or materials you submit through the Site.
13. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms and update the Effective Date. If a change materially affects your rights, we may provide additional notice, such as through the Site or by email. Changes apply prospectively beginning on their stated effective date.
14. Termination
We may suspend, restrict, or discontinue access to the Site, in whole or in part, at any time and without notice.
15. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Los Angeles County, California, and you consent to their jurisdiction. This section does not deprive you of protections that cannot be waived under the laws applicable where you reside.
16. General
If any provision of these Terms is found unenforceable, that provision will be limited or severed and the remaining provisions will stay in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, financing, reorganization, or sale of assets. Sections 4 and 6 through 16 survive any termination of these Terms. Headings are for convenience only and do not affect interpretation. These Terms are the entire agreement between you and us regarding the Site.
