Human is a product of Tens, Inc. (“Human,” “we,” “us,” or “our”). This Privacy Policy explains what personal information we collect through achievewithhuman.com (the “Site”), how we use and disclose it, and the choices you have. Tens, Inc. is the entity responsible for the personal information described here.

Right now, the Site is an informational website where you can learn about Human, join our waitlist, and contact us. The Human app is not yet live, so the information we collect is limited. When we make an app or beta available, it will have its own privacy policy.

1. Information We Collect

Information you give us. When you join our waitlist or contact us, we collect the email address you submit, along with your name and the contents of any message you choose to send. If you reach out about investing, we collect what you provide in that inquiry.

Information collected automatically. Our Site is hosted on Squarespace. Our website platform and analytics providers automatically log technical information when you visit, including your IP address, browser and device type, operating system, referring page, the pages you view, and the dates and times of your visits. We use this to keep the Site running, protect it from abuse, and understand general traffic patterns.

We do not collect Social Security numbers, government ID numbers, financial account information, precise geolocation, or sensitive personal information through the Site.

2. Cookies and Similar Technologies

We use cookies and similar technologies that are necessary to operate and secure the Site. We also use analytics technologies — including analytics provided by our website platform and, from time to time, third-party analytics services — to understand how visitors find and use the Site, which pages they view, and how the Site is performing.

We do not use cookies or similar technologies for advertising or retargeting, and we do not engage in cross-context behavioral advertising.

You can block or delete cookies through your browser settings. Parts of the Site may not work as well if you do.

3. Do Not Track and Other Privacy Signals

Some browsers offer a “Do Not Track” setting. Because there is not currently a uniform standard for responding to these signals, the Site does not respond to Do Not Track signals. We do not sell personal information or share it for cross-context behavioral advertising. If we become legally required to recognize an opt-out preference signal, such as Global Privacy Control, we will do so.

Our service providers may collect information through the Site on our behalf in order to provide hosting, security, analytics, and email services. We do not authorize them to use that information for their own advertising purposes, and we do not permit third parties to collect personal information about your online activities over time and across different websites when you visit the Site.

4. How We Use Your Information

We use the personal information we collect to:

  • —Send you waitlist confirmations, product news, launch and early-access information, company updates, and related marketing communications
  • —Respond to questions, contact-form submissions, and investor inquiries
  • —Operate, maintain, secure, troubleshoot, and improve the Site
  • —Detect and prevent fraud, abuse, and security incidents
  • —Comply with legal obligations and enforce our Terms of Service

5. We Do Not Sell or Share Your Information

We do not sell your personal information, and we do not share it for cross-context behavioral advertising. We also do not disclose your personal information to third parties for their own direct marketing purposes, as that phrase is used in California Civil Code § 1798.83.

6. Who We Disclose Information To

We disclose personal information only to:

  • —Service providers who operate the Site and our communications on our behalf — including our website host and platform (Squarespace), our analytics providers, and our email marketing provider. They are permitted to use your information only to provide services to us.
  • —Professional advisors, such as our attorneys and accountants, where reasonably necessary.
  • —Legal and safety recipients, when we are required to disclose information by law, subpoena, or legal process, or where disclosure is necessary to protect the rights, safety, or property of Tens, Inc., our users, or the public.
  • —A successor entity, in connection with a merger, acquisition, financing, reorganization, or sale of assets. If required by law, we will notify you of material changes affecting how your personal information will be handled.

7. Your Choices and Rights

Unsubscribe. Every marketing email we send includes an unsubscribe link. You may also email us at the address in Section 12 and we will remove you from our lists.

Access, correction, and deletion. You may ask us what personal information we hold about you, ask us to correct inaccurate information, or ask us to delete it. Email us at the address in Section 12 with your request and the email address you signed up with. We will respond within a reasonable time and within any period required by applicable law, and we may need to verify your identity before acting on your request.

California residents. Depending on applicable law, California residents may have rights relating to their personal information, including rights to request access, correction, or deletion and to receive information about our privacy practices. Regardless of whether a particular privacy law applies to us, you may contact us to request access to, correction of, or deletion of personal information we maintain about you. We may need to verify your identity before completing a request, and we will not discriminate against you for making one. As stated in Section 5, we do not sell personal information or share it for cross-context behavioral advertising.

8. Additional Information for Visitors in the EU, EEA, and UK

Legal bases for processing. If European or UK data protection law applies, we process personal data on the following legal bases:

  • —Your consent, when you sign up for email updates. You may withdraw consent at any time, which does not affect processing carried out before withdrawal.
  • —Our legitimate interests in operating, securing, analyzing, and improving the Site, where those interests are not overridden by your rights.
  • —Compliance with our legal obligations.

Your rights. You have the right to access, correct, delete, restrict, and port your personal data, and to object to processing carried out on the basis of our legitimate interests.

International transfers. Tens, Inc. is based in the United States. If you access the Site from outside the United States, your information may be transferred to and processed in the United States and other countries where our service providers operate. These countries may have data protection laws that differ from those in your country. Where required, we use legally recognized safeguards for these transfers.

Complaints. You may lodge a complaint with the data protection authority in the country where you live or work, or where you believe a violation occurred.

9. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this Policy.

We retain your email address while you are subscribed to our updates. If you unsubscribe, we may retain your email address on a suppression list so that we can honor your request not to receive further marketing emails.

We retain contact and inquiry messages for as long as reasonably necessary to respond and to maintain appropriate business records. Technical logs and analytics information are retained according to our security needs and the retention settings of our service providers. We may retain limited information for longer where required by law, to resolve disputes, or to enforce our agreements.

10. Security

We use reasonable administrative and technical measures designed to protect the personal information we collect, and we rely on the security controls of our platform and service providers. No method of transmission or storage over the internet is completely secure, so we cannot guarantee absolute security.

11. Children

The Site is not directed to children under 13, and we do not knowingly collect personal information from anyone under 13. If you believe a child under 13 has provided us with personal information, please contact us and we will delete it.

13. Changes to This Policy

We may update this Privacy Policy from time to time. When we do, we will post the revised policy on this page and update the Effective Date above. If we make material changes, we will update the Effective Date and provide any additional notice required by applicable law. Changes take effect on the stated Effective Date.
